Terms of Service
By using a ChargeArena station or our website, you agree to these terms. We sell electricity through DC fast chargers at posted tariffs. You agree to use the equipment safely, only with a compatible vehicle, and to pay for the energy you consume. We auto-refund any unused balance. Disputes are governed by Indian law and the courts at Nashik, Maharashtra.
01 Acceptance of terms
These Terms of Service ("Terms") form a binding agreement between you and ChargeArena Private Limited, operating the ChargeArena brand ("ChargeArena," "we," "us"). They govern your access to and use of ChargeArena charging stations, the chargearena.in website, and the charging web app delivered through AmpPay.
By initiating a charging session, scanning a ChargeArena QR code, or otherwise using our service, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy and Refund Policy.
02 The service
ChargeArena operates a network of high-power DC fast charging stations at highway-adjacent hotel and restaurant properties across Maharashtra. The service comprises:
- Public access to 160 kW+ DC fast charging with dual CCS2 connectors and True Dynamic load balancing.
- App-less session initiation via QR code scan and a browser-based interface powered by AmpPay.
- UPI-based payment with automatic refund of any unused pre-paid balance at session end.
- Real-time session monitoring, receipts, and multilingual customer support.
- Discovery and session initiation through partner networks via the YoCharge platform.
2.1 Role clarification
ChargeArena is the Charge Point Operator. We sell the energy dispensed through our chargers at posted tariffs. ChargeArena is not a payment service provider — all payment transactions are processed exclusively by RBI-licensed payment partners (Kotak Bank, CCAvenue) through our affiliated payments platform, AmpPay.
03 Eligibility
To use ChargeArena, you must:
- Be at least eighteen (18) years of age and competent to enter a contract under Indian law.
- Own or lawfully operate an electric vehicle compatible with the CCS2 connector standard.
- Hold a valid UPI account or other supported payment instrument issued by an RBI-regulated entity.
- Comply with all applicable laws and regulations of the Republic of India.
04 Tariffs and payment
4.1 Posted tariffs
Energy tariffs are displayed on the charger screen, on the in-browser charging interface, and at the station signage before you initiate a session. Tariffs vary by station based on the underlying electricity-supply cost (HT vs. LT connections), as approved by the Maharashtra Electricity Regulatory Commission (MERC). Current indicative tariffs:
- HT-connected stations (e.g., Nashik) — ₹20 per unit (kWh).
- LT-connected stations (e.g., Shirdi, Sambhaji Nagar) — ₹19 per unit (kWh).
Tariffs may change with prior notice on the charger and the website. The tariff displayed at the moment you confirm a session is the tariff that applies to that session.
4.2 How payment works
You pre-pay for an amount of energy via UPI. Charging begins immediately after payment confirmation. You may stop the session at any time. At session end (whether complete, manually stopped, or interrupted), any unused balance is refunded automatically to your original UPI account within sixty (60) seconds.
4.3 Taxes
All tariffs include applicable taxes unless explicitly stated otherwise. A GST-compliant receipt is generated automatically and made available via SMS, email, or in-browser download.
05 Your responsibilities as a driver
When using a ChargeArena station, you agree to:
- Verify that your vehicle is compatible with the CCS2 connector before initiating a session.
- Follow all instructions displayed on the charger and the in-browser interface.
- Park within the bay markings; do not block the bay after your session ends.
- Handle the connector and cable carefully; do not pull the cable while a session is live.
- Not tamper with, vandalise, or attempt to bypass any part of the charging hardware, software, or signage.
- Not use the service for any unlawful purpose, including but not limited to fraud, theft of electricity, or charging stolen vehicles.
- Provide accurate information when prompted (mobile number, vehicle details).
- Take all reasonable safety precautions for yourself, your vehicle, and other users of the site.
06 Safety and vehicle compatibility
ChargeArena chargers conform to applicable Indian and international standards (IS 17017, OCPP 2.0.1, CCS2). However, charging is performed at the driver's own risk. ChargeArena is not liable for vehicle damage, battery degradation, or data loss arising from:
(a) using a vehicle whose battery, charging system, or connector is faulty, modified, or non-compliant with manufacturer specifications;
(b) ignoring on-screen safety warnings or fault codes;
(c) extreme weather, force majeure, or interruptions in the grid supply beyond our reasonable control;
(d) third-party hardware defects covered by the manufacturer's warranty, against which we will assist you in claiming.
If a charger displays a fault, do not attempt to use it. Report the fault to support@amppay.in or via the in-browser support flow.
07 Service availability
We target high service availability across all live stations but do not guarantee uninterrupted operation. Sessions may be interrupted by:
- Scheduled maintenance — communicated in advance where possible.
- Emergency repairs, safety incidents, or hardware faults.
- MSEDCL grid outages, low voltage, or curtailment.
- Network connectivity issues affecting the OCPP link, AmpPay, or the YoCharge platform.
- Force majeure — fire, flood, earthquake, civil unrest, government action, pandemic, or other events outside our reasonable control.
Where a session is interrupted, our Refund Policy describes how unused energy is refunded.
08 Site host and franchise relationships
Some ChargeArena stations are deployed under a profit-sharing arrangement with the site host (typically a hotel or restaurant on whose property the station sits) or under a franchise agreement. Those commercial arrangements are governed by separate written agreements between ChargeArena and the host or franchisee. As a driver, your contractual relationship is solely with ChargeArena — you are not a party to the site-host or franchise agreement.
09 Intellectual property
The ChargeArena name, the wordmark, the canopy and bay design, the AmpPay platform, the chargearena.in website, all content, software, and supporting materials are the property of ChargeArena Private Limited and are protected by Indian and international intellectual-property laws.
You may not copy, modify, reverse engineer, decompile, distribute, frame, scrape, or create derivative works of any part of the service without our prior written consent. Limited fair use for personal, non-commercial purposes (e.g., taking a photograph of the canopy) is permitted.
10 Limitation of liability
To the maximum extent permitted by Indian law:
- ChargeArena's total aggregate liability for any claim arising out of or related to these Terms or your use of the service shall not exceed the total amount paid by you to ChargeArena for charging sessions in the three (3) months preceding the event giving rise to the claim.
- ChargeArena is not liable for indirect, consequential, incidental, exemplary, or punitive damages — including loss of profits, loss of business, loss of vehicle use, or loss of data.
- The limitation does not exclude liability for death or personal injury caused by our gross negligence, fraud, or any liability that cannot be limited under applicable law.
11 Indemnification
You agree to indemnify and hold harmless ChargeArena, ChargeArena Private Limited, its directors, employees, agents, and affiliates from any claim, loss, liability, expense, or damage (including reasonable legal fees) arising from:
- Your violation of these Terms.
- Your misuse or unsafe operation of the charging equipment.
- Your infringement of any third party's rights — including intellectual property, privacy, or property rights.
- Any act of fraud, misrepresentation, or unlawful conduct on your part.
12 Suspension and termination
We may suspend or terminate your access to the service, with or without notice, if we have reasonable grounds to believe that you have:
- Violated these Terms or any applicable law.
- Engaged in fraudulent or abusive use of the platform.
- Tampered with or damaged ChargeArena equipment or site host property.
- Failed to pay amounts due, or initiated chargebacks without legitimate cause.
Termination does not affect rights and obligations that, by their nature, are intended to survive — including limitation of liability, indemnification, governing law, and intellectual property.
13 Privacy
Your use of the service is also governed by our Privacy Policy, which describes how we collect, use, share, and protect personal data, and your rights under the DPDP Act, 2023.
14 Refunds and disputes
Refund eligibility, automatic refunds, manual refund requests, and refund timelines are governed by our Refund Policy. Refund requests must be raised within seven (7) days of the relevant transaction.
15 Modifications to these Terms
We may revise these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be notified by email (if we hold your email) or by a prominent notice on the website at least thirty (30) days before they take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
16 Governing law and jurisdiction
These Terms are governed by, and construed in accordance with, the laws of the Republic of India. Any dispute arising out of or in connection with these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts at Nashik, Maharashtra.
Before initiating litigation, the parties shall make a good-faith attempt to resolve the dispute by writing to support@amppay.in. Unresolved consumer disputes may also be raised before the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
17 Grievance Officer
In compliance with the Information Technology Act, 2000, the Consumer Protection (E-Commerce) Rules, 2020, and the Intermediary Guidelines, we have designated a Grievance Officer to address consumer grievances arising from the use of our service.
